- Correction of Personal Information
When requested by a user to correct or add to their personal information, our company will verify that it is the user themselves and confirm the accuracy of the corrections before taking appropriate action.
- Disclaimer
Our company will not be responsible for the acquisition of personal information by third parties in the following cases:
(1) When the user themselves reveals personal information to a third party using our service’s functions or other means
(2) When an individual can be identified based on information entered by the user on our service
- Revisions to the Privacy Policy
We may revise all or part of the Privacy Policy without prior notice. In case of changes, we will notify you on this website.
Article 6: Confidentiality of Communications
- We will protect the confidentiality of users’ communications in accordance with Article 4 of the Telecommunications Business Act (Act No. 86 of 1984).
- We shall not be bound by the confidentiality obligation set forth in the preceding paragraph in the following cases, to the extent specified in each item:
(1) When compulsory measures or court orders are carried out based on the Code of Criminal Procedure (Act No. 131 of 1948) or the Act on Wiretapping for Criminal Investigation (Act No. 137 of 1999).
(2) When compulsory measures are carried out based on laws and regulations.
(3) When we determine that the requirements for disclosure requests based on Article 4 of the Act on the Limitation of Liability for Damages of Specified Telecommunications Service Providers and the Right to Demand Disclosure of Identification Information of the Senders (Act No. 137 of 2001) have been met.
(4) When we determine it necessary for the protection of life, body, or property of others.
Article 7: Membership
- Those who wish to use the Service shall apply for membership in the manner prescribed by us after agreeing to the contents of these Terms.
- Those who have applied for membership (hereinafter referred to as “membership applicants”) become users at the time we approve their membership application.
- We may, at our discretion, refuse to approve a membership application without disclosing the reason if any of the following apply:
(1) If the membership applicant applies for membership by a method other than that specified in paragraph 2 of the preceding article.
(2) If the membership applicant is a person who has been subject to forced withdrawal due to violation of these Terms or other terms of use in the past.
(3) Other cases where we deem it inappropriate.
Article 8: Withdrawal
- If a user wishes to withdraw, they shall notify us of their intention to withdraw in the manner prescribed by us.
- We may, at our discretion, forcibly withdraw users and refuse to allow them to use the Service if they engage in any of the following acts:
(1) If it becomes clear that they applied for membership by a method other than that specified in Article 7.
(2) If they violate these Terms or other terms of use.
(3) Other cases where we deem it inappropriate.
Article 9: Management of Registered Email Address and Password
- Users must register a usable email address under their control as their registered email address.
- Users shall make efforts to prevent unauthorized use of their registered email address and password and shall be fully responsible for their management.
- We shall not be liable for any damages caused by the use of registered email addresses or passwords by third parties, except in cases of gross negligence on our part.
Article 10: Account Possession
- Users shall possess one account per person. One person cannot possess multiple accounts, and multiple people cannot jointly possess one account, except as otherwise approved by us.
- Users may not transfer or lend their account to a third party under any circumstances.
Article 11: Preparation of Usage Environment
- Users shall prepare all necessary hardware and software for using the Service at their own expense and responsibility.
- Users shall take security measures such as prevention of computer virus infection, unauthorized access, and information leakage according to their usage environment.
- We are not involved in and do not assume any responsibility for users’ usage environments.
Article 12: User Responsibility
- Users shall use the Service at their own responsibility and shall be fully responsible for all actions taken and their results when using the Service.
- If a user defames another person’s reputation, violates privacy rights, discloses personal information of a third party without permission, engages in acts that violate the Copyright Act (Act No. 48 of 1970), or otherwise infringes on the rights of others, the user must resolve the issue at their own responsibility and expense, and we shall not bear any responsibility.
- Users acknowledge that we have no obligation to store information posted by users through the Service and shall take appropriate backups.
- All responsibility for information such as images posted by users through the Service rests with the users.
Article 13: Prohibited Actions
Users shall not engage in the following actions when using the Service. If users violate these prohibitions, we may take unfavorable measures such as forced withdrawal, suspension of use, deletion of all or part of the posted information, or change of public scope:
(1) Actions that infringe or may infringe on our or others’ intellectual property rights such as copyrights or trademarks.
(2) Actions that infringe or may infringe on our or others’ property, privacy, or portrait rights.
(3) Actions that unfairly discriminate against or defame us or others, promote unfair discrimination against others, or damage their honor or credibility.
(4) Actions of impersonating someone else, pretending to have representation or agency rights without actually having them, or falsely claiming to be in partnership or cooperation with other individuals or organizations when using the Service.
(5) Actions that are linked to or may be linked to crimes such as fraud, abuse of regulated drugs, child prostitution, illegal sale of bank accounts and mobile phones.
(6) Regarding information equivalent to obscenity, child pornography, or child abuse (hereinafter referred to as “such information” in this item), any of the following actions:
(a) Posting or displaying such information.
(b) Selling media containing such information.
(c) Posting or displaying advertisements that suggest the transmission, display, or sale of media containing such information.
(7) Actions of conducting or soliciting participation in illegal gambling.
(8) Actions of undertaking, mediating, or inducing illegal acts (such as transfer of firearms, manufacture of explosives, provision of child pornography, forgery of public documents, murder, threats, etc.).
(9) Actions of inducing or soliciting others to commit suicide.
(10) Actions of posting or displaying the following information:
(a) Information photographing scenes of killing or injuring people.
(b) Information photographing corpses.
(c) Information photographing other cruel acts.
(11) Actions of posting the following types of information:
(a) Information that defames specific individuals.
(b) Information that can identify individuals such as names, addresses, workplaces, phone numbers, etc.
(c) Information unrelated to the review subject.
(d) Other information deemed inappropriate by us.
(12) Actions of posting the following types of information in areas where posting is possible on this site:
(a) Information for commercial advertising, promotion, or solicitation purposes, except as otherwise approved by us.
(b) Information containing affiliate links.
(c) Information soliciting others such as pyramid schemes, chain letters, MLM, paid emails, etc.
(d) Information leading to sites deemed inappropriate by us, such as adult sites, one-click fraud sites, sites aiming to spread harmful computer programs like viruses, etc. (including simply linking to such sites).
(e) Other information deemed inappropriate by us.
(13) Actions that disadvantage other users through posted information.
(14) Engaging in the following spam activities:
(a) Spam posting: Acts by one or multiple users of posting the same or similar text in areas where posting is possible on this site or sending messages.
(b) Spam words: Acts by one or multiple users of listing multiple words that are irrelevant or have low relevance to the area where posting is possible on this site, or posting extremely long text or a large number of words.
(c) Spam URL: Acts by one or multiple users of posting the same URL in areas where posting is possible on this site or sending messages.
(d) Other acts deemed as spam by us.
(15) Acts of one person possessing multiple accounts or multiple people jointly possessing one account, except as otherwise approved by us.
(16) Acts of illegally rewriting or deleting information stored in our facilities.
(17) Acts of transmitting or posting harmful computer programs such as viruses.
(18) Acts that place a burden on our or others’ servers, or acts that disrupt or may disrupt the operation of the Service or network/system.
(19) Acts of linking to content while knowing that the act falls under any of the preceding items, with the purpose of promoting such acts.
(20) Acts that we determine violate laws, public order and morals, these Terms or other terms of use, or infringe on the rights of others.
(21) Other acts deemed inappropriate by us.
(22) Even in cases where the use of multiple accounts is permitted, acts deemed to hinder the healthy operation of the Service.
Article 14: Changes to the Service
We may add, change, suspend, or terminate the Service at any time for any reason at our discretion.
Article 15: Usage Fees
- Registration and basic services are free of charge.
- Usage fees, payment methods, etc., for paid services shall be as stipulated in separate paid service terms of use.
Article 16: Intellectual Property Rights, etc.
(1) Users are deemed to have granted and agree in advance to grant us or persons designated by us the right (including the right to sublicense) to freely use (including reproduction, publication, transmission, distribution, transfer, lending, translation, adaptation) the content sent (transmitted) by users, without compensation, non-exclusively and without any restrictions, domestically and internationally, for the duration of the copyright and all other rights related to such content. Users shall not exercise their moral rights as authors of such content against us and persons designated by us, even if they retain such rights.
(2) Users shall resolve at their own responsibility and expense all claims and demands arising from or related to the content sent (transmitted) by users, users’ use of the Service, connection, violation of the terms, and users’ infringement of third-party rights.
(3) If we incur expenses or pay compensation, etc., in relation to responding to claims and demands mentioned in the preceding paragraph, the user shall bear such expenses and compensation, including attorney fees paid by us, and we may claim payment of the total amount from the user.
(4) Users acknowledge that we have no obligation to store the content sent (transmitted) by users and shall take appropriate backups of necessary content.
(5) We may view the content sent (transmitted) by users as necessary for operation, and if we determine that it violates the terms, we may make all or part of such content non-public or delete it without prior notice to the user.
Article 17: Our Property Rights
(1) Except for the content and information sent (transmitted) by users, all property rights related to all content and information included in the Service belong to us.
(2) Content posted or provided in the Service or advertisements is protected by copyright law, trademark law, design law, etc.
(3) All software used in relation to the Service and the Service itself contains property rights and trade secrets protected by laws and regulations related to intellectual property rights.
Article 18: Disclaimer
- We do not intervene in users’ communications or activities. In case of disputes between users, they shall be resolved between the users involved, and we shall not be responsible.
- We shall not be liable for any damages caused by the addition, change, interruption, or termination of the Service content. The same applies in cases of slow display speed or failures due to excessive access or other unforeseen factors.
- We have no obligation to monitor or store information posted by users.
- We are not responsible for the legality, morality, reliability, or accuracy of information posted by users. We are also not responsible for whether information posted by users complies with the internal rules of the corporations or organizations to which the users belong.
- We may view, store, or disclose to third parties (hereinafter referred to as “viewing, etc.” in this paragraph) the content of information in the following cases. We shall not be liable for any damages caused by such actions:
(1) When we send an email to the registered email address of the user who posted the information requesting consent for viewing, etc., and any of the following applies:
(a) When the user consents to viewing, etc.
(b) When no email response from the user refusing viewing, etc., reaches our mail server within 7 days of sending the email requesting consent for viewing, etc. However, this does not apply in cases of urgent and unavoidable circumstances.
(2) When necessary to identify and resolve technical issues with the Service.
(3) When receiving an official inquiry based on laws and regulations from courts, police, or other public institutions.
(4) When we determine that it is necessary to confirm the content of information due to acts or potential acts that violate these Terms.
(5) When we determine that there is an imminent danger to life, body, or property, and there is an urgent necessity.
(6) When any of the items listed in Article 6, Paragraph 2 apply.
(7) When otherwise necessary for the proper operation of this site.
- We may take measures such as forced withdrawal of users, deletion of all or part of information, and change of public scope if we have reasonable grounds to believe that acts violating these Terms or other terms of use have been committed or may be committed. We shall not be liable for any damages caused by such actions.
Article 19: Our Right to Delete
We may take unfavorable measures such as deleting all or part of related information or changing the public scope, regardless of the illegality or violation of terms of the information, in the following cases:
(1) When information deemed obscene by us is posted.
(2) When public institutions or experts (including reliability verification organizations specified in the guidelines of the Act on the Limitation of Liability for Damages of Specified Telecommunications Service Providers and the Right to Demand Disclosure of Identification Information of the Senders, Internet Hotline, lawyers, etc.) point out or express opinions that the information is illegal, violates public order and morals, or infringes on the rights of others.
(3) When there are claims of rights by third parties regarding posted information.
(4) When we determine that posted information infringes on the copyrights of third parties.
Article 20: Validity of These Terms and Other Terms of Use
- Even if part of the provisions of these Terms and other terms of use is deemed invalid based on laws and regulations, other provisions of these Terms and other terms of use shall remain valid.
- Even if part of the provisions of the terms of use is deemed invalid or canceled in relation to a certain user, the terms of use shall remain valid in relation to other users.
Article 21: Measures Against Violations of These Terms or Other Terms of Use
- If it is determined that a user has violated these Terms or other terms of use, or if we deem it necessary, we may take the following measures against the user:
(1) Request voluntary deletion or correction of information.
(2) Delete all or part of the information, change the public scope, or make it unavailable for viewing (non-public).
(3) Impose forced withdrawal.
(4) Refuse to approve membership applications from applicants.
- Users may not raise objections to the measures mentioned in the preceding paragraph.
Article 22: Governing Law
- The governing law of these Terms shall be Japanese law.
Supplementary Provisions
- These Terms shall come into effect on August 1, 2008.
- These Terms shall come into effect on December 20, 2019.
- These Terms shall also apply to actions taken by users before the enforcement of these Terms.
